The Gambier Island Local Trust Committee ended its consideration of a temporary-use permit for short-term rentals, tent sites, an RV, a concession and non-motorized watercraft rentals at 670 Andy’s Bay Road, directing Islands Trust bylaw staff to enforce the Gambier Land Use Bylaws.[1]
The committee’s minutes say staff reported 70 items of correspondence opposed to the application and one in support. The applicant’s agents said they had stopped taking additional bookings through Airbnb and VRBO while working toward compliance, and had scheduled repairs to the sewage system.[1]
Trustees said the proposal did not demonstrate a community benefit warranting an expanded operation, and that the New Brighton area lacked appropriate public access and emergency services, including fire suppression, to support the proposed commercial business. The minutes also record concerns about consultation with neighbours and community opposition.[1]
The motion to proceed no further with the application and enforce the bylaws carried. The chair said the application was closed and the applicant could reapply after a 12-month period.[1]
The committee also adopted a policy directing staff to request that applicants cease a land use that contravenes a bylaw before processing an application, and to continue enforcement until the use ceases. The policy allows the committee to direct enforcement actions to cease if it considers there is a community need to process an application while the prohibited use continues.[1]
The meeting recording transcript includes public comments about the permit and the committee’s discussion of the application. The minutes record the committee’s decision and the policy it adopted.[2]
